Senate Bill 9 Duplex and Urban Lot Splits

California Senate Bill 9 (SB 9) created a “ministerial approval process” for “duplex” and “urban lot split” projects in single-family residential (RS-8 & RS-12) zones. To qualify for the “ministerial approval process,” the project must satisfy the eligibility requirements listed in Government Code §65852.21 and/or §66411.7. To apply for ministerial review pursuant to SB 9, the applicant must complete the following Senate Bill 9 Duplex and Urban Lot Split Eligibility Checklist. In addition to this checklist form, the applicant must also provide architectural plans, a Parcel Map (if proposing an “urban lot split”), and any other documents listed herein. Additionally, all projects must comply with the objective design standards, and standard conditions of approval (See SB 9 Ordinance & Objective Standards).

Applicants shall include the following with the application packet:

1. An Exhibit showing the existing and proposed lot lines, any proposed improvements, easements and utilities.

2. A Title report not older than 90 days.

3. Copies of any easement documents as applicable.

4. Copy of the proposed parcel map.

See 16.12.040 to 16.12.080 of the Seaside Municipal Code specifically as well as Chapter 16 for general requirements.

Fees:

As of July 2021, the adopted Engineering fee is the actual cost to perform review, with a deposit of $1,500. The Planning Department review fee is $5,530.

Document Submittal:

Please provide electronic copies of documents until the application is approved. Then submit two printed copies of the parcel map for approval and signatures of the City Engineer, City Surveyor, and Secretary of the Planning Commission.
